CTP injury rehabilitation, Inner West Sydney
Injured in a motor accident in NSW. Treatment under the CTP scheme is billed to the insurer, and you can start it before liability is decided.
CTP, compulsory third party, is the scheme that covers injuries from motor accidents in New South Wales. It is separate from workers compensation, though both are overseen by SIRA and both bill treatment directly to an insurer.
The important practical difference is timing. Under CTP you can receive up to 26 weeks of treatment and income support regardless of who was at fault, provided the accident is reported to police and a claim is lodged.
What has to be in place
There are time limits on a CTP claim, and they are shorter than most people expect.
Report to police
The accident must be reported to police, and you need the event number. Without it a CTP claim cannot proceed.
Lodge within 28 days
Lodging a personal injury claim form with the at-fault vehicle's CTP insurer within 28 days is what secures backdated weekly payments. A claim can still be lodged up to three months, with a reduced entitlement.
See a doctor
A certificate of fitness from your GP records the injury and your capacity. It is the CTP equivalent of the certificate of capacity used in workers compensation.
Start treatment
Statutory benefits cover reasonable and necessary treatment for the first 26 weeks regardless of fault. Bring your claim number and we invoice the insurer directly.
Whiplash and the first twelve weeks
Most CTP claims involve neck and back injury from the accident itself. NSW guidelines for whiplash associated disorder favour early movement, reassurance and a graded return to normal activity over rest and immobilisation.
That means treatment usually starts within days rather than waiting for scans. Imaging is arranged where there are clinical reasons for it, not routinely.
Beyond 26 weeks
Statutory benefits past 26 weeks depend on fault and on the injury being more than a minor one. If your recovery is heading that way, the clinical documentation from the first six months is what the assessment rests on, which is a reason to have it done properly from the start.
